Legal basis

If the data is processed for the performance of a contract with the data subject, including pre-contractual measures, the legal basis is Art. 6 para. 1 lit. b DSGVO or Art. 13 para. 2 lit. a DSG or Art. 31 para. 2 lit. a nDSG. If the processing is necessary to protect a legitimate interest of our company or a third party, Art. 6 para. 1 lit. f DSGVO or Art. 13 para. 1 DSG or Art. 31 para. 1 nDSG serves as the legal basis for the processing. This applies, for example, to marketing, unless you have objected to the use of your data for marketing purposes.
Legitimate interests may include, in particular, further:
- Operation and administration of the website;
- The provision of services and/or information intended for you;
- The prevention and detection of fraud and crime;
- The processing of personal data for administrative purposes;
- Assertion, exercise or defense of legal claims;
- Responding to inquiries;
- Informing the public and interested parties;
- Carrying out direct marketing activities.

We have many of the following data because you have provided them to us (e.g. via registration etc.). If you conclude a contract with us by obtaining a service, you must provide certain data on the basis of your contractual obligation, such as master data. If it is behavioral or preference data, you may object to the data processing or not give your consent to it.

Data processing for the realization of the running event
For the registration and execution of the running event, only the surname, first name, year of birth and address as well as the e-mail address are required from the runners as mandatory data. Further data is only collected on a voluntary basis and only if it is necessary for the provision of a further service. We process this data for the purpose of carrying out the running event, including delivery of information about your participation and the starting documents (digital starting package) as well as a feedback request after the run. The processing is carried out for the execution of the contract (Art. 6 para. 1 lit. b DSGVO or Art. 13 para. 2 lit. a DSG or Art. 31 para. 2 lit. a nDSG) that you have concluded with us, as well as on the basis of an overriding or legitimate interest (administrative purposes; Art. 6 para. 1 lit. f DSGVO or Art. 13 para. 1 DSG or Art. 31 para. 1 nDSG) of us.
Creation and publication of start and ranking lists
The name, first name, year of birth, place of residence, category and running time will be published in starting lists and ranking lists. A publication of the complete address does not take place.
At the event, times will be recorded at various points as the runner passes by and electronically assigned to the runner crossing by means of a transponder. From this data set, lap and/or course times are determined for the runners and result lists are created from this. These data will be published during and after the event on site and on the internet as well as in print media if necessary. The publication of the rankings on the Internet takes place on the website of the organizer and on the website of the timing providers (TrackMaxx), as well as integrated into the Swiss Athletics and Abbott World Marathon Majors ranking list.

The publication of the data serves the comparison of the participants among each other, which is typical for competitions. The data is processed based on a legitimate interest (information of the public and interested parties; Art. 6 para. 1 lit. f DSGVO or Art. 13 para. 1 DSG or Art. 31 para. 1 nDSG). The runner can request that his or her name be removed from the publicly viewable results list after the end of the event.

Passing on of data
Companies that work on our behalf for the organization and implementation of the running events, the processing of registrations (online, offline), the administration of the participants' data, the collection, possibly the timing, results service, bib processes, participant advertising and information, process the data on our behalf and for our purposes. We choose our service providers carefully and are obliged by law to control the data processing by these companies and to oblige them not to process the data for their own purposes or to pass it on to unauthorized third parties. We point out that it is possible that your data will be processed by our service providers both in the EU/EEA and in countries without an adequate level of data protection. If we use such providers in insecure countries, the transfer is based on Art. 46 para. 1 lit. c DSGVO or Art. 16 para. 2 lit. d nDSG.

If you take part in a running event, you consent to the transfer of your personal data such as surname and first name, private address (street, no. zip code and city) date of birth, telephone number, and e-mail address to partners (e.g. photo and video service), unless you prohibit the transfer of the data by sending a message to the postal or e-mail address given below. These partners may use the data for their own services or advertising purposes and, in the case of sponsors, for targeted addresses and telephone campaigns in connection with the running event.
If we are required by law to do so, we will obtain the runner's consent at registration before disclosing personal data to third-party companies that process the data for their own purposes (the provision of their own services).

You can revoke the consent to share the data with third parties at any time.

With the registration you become at the same time a running member of Swiss Athletics and the umbrella organization Swiss Olympic. For this purpose, we will pass on your name and e-mail address to Swiss Athletics. Your data will be used exclusively for your entry as a member and will not be passed on to third parties. At the beginning of the year you will receive a newsmail with an overview of the most beautiful Swiss races. This membership is free of charge for you and expires (after one year) at the end of the following calendar year. More information at www.swiss-running.ch/datenschutz.
